Judgment Talks (5)

Course Description: The student will become familiar with the rulings on felonies, blood money, punishments (hudud), foods, sacrifice, aqiqah, oaths, vows, judgments, and emancipation. The course will also cover extracting hadith from their sources, indicating their degree of authenticity or weakness and the general reason for it, explaining obscure vocabulary through books of hadith vocabulary, understanding the general meaning of hadith, and knowing the reason for its narration if it is known.

Objectives of the course :

1- Identification of the Sharia basis for the topics of (felonies, hadd punishments, foods, oaths and vows, judgments, and manumission).
2- Identifying authentic hadith from weak ones.
The ability to understand speech correctly.
4. The ability to derive jurisprudential rulings from Hadith.
5. Extracting and tasting the spiritual values from the Prophet's hadith.
6- Comparison between the methods of extremism, leniency, and neglect in understanding hadith.
7 – Self-development.

Course outputs :

Knowledge and understanding:
1- That the student becomes acquainted with the legitimate derivation of the topics of felonies, blood money, oaths, and vows.
2- The student should review what is permissible and impermissible in sacrifices.
3- That the student identify the ruling on eating horses and domestic donkeys.
Skills:
1- The student will compare the statute of limitations for slander and drinking offenses.
2- That the student analyze the ruling on women assuming the judiciary.
3. The student explains the difference between the sacrifice (udhiyah) and the Aqiqah.
Values, autonomy and responsibility:
1. The student will practice executing an individual or group assignment.
2. The student will practice honesty in presenting and critiquing others' statements and will take responsibility.

Book of Felonies
Ibn Mas'ud does not permit the blood of a Muslim who testifies that there is no god but Allah.

Aisha does not cut off a thief's hand unless it is for a quarter dinar or more.

Chapter on the legal limit for the mustache and the clarification of intoxicants:
14. Anas reported that a man who had drunk wine was brought to the Prophet (peace be upon him), and he had him flogged.
15. Jabir said: "What intoxicates in large amounts is forbidden in small amounts.".
Chapter on Ta'zir and the Ruling on the Aggressor:
16. Abu Burda al-Ansari does not whip more than ten lashes except in a prescribed punishment of Allah.
Book of Foods:
In eating the meat of some animals.
17. Ibn Abbas forbade everything with fangs and everything with claws.
18. Jabir forbade the eating of domestic donkeys on the day of Khaybar.
19. Asma bint Abi Bakr said: We slaughtered a horse during the time of the Messenger of Allah, peace be upon him, and we ate it.
Ibn Abbas ate the dab on the table of the Messenger of Allah (peace be upon him).

21. 'Uday ibn Hatim: If you send your dog, mention the name of Allah over it.

24. Al-Bara' ibn 'Azib (may Allah be pleased with him) said: Four things are not permissible in sacrificial animals: one-eyed with the defect apparent.

Samrah bin Jundab narrated that every child is mortgaged by its *aqiqah*, which is sacrificed on its behalf on the seventh day.

26. Ibn 'Umar reported that Allah forbids you from swearing by your fathers.
27. Abdur-Rahman bin Samurah: If you swear an oath and then see something else that is better than it...
28. Ibn Umar, if someone takes an oath and says, "Insha'Allah" (if God wills), then there is no breaking of the oath upon him.
29. Ibn Umar reported that the Prophet, peace be upon him, forbade vows and said, "They do not bring anything good.".
30. Ibn Abbas asked Sa'd ibn Ubadah about a vow his mother had made... fulfill it.
Book of Jurisprudence
31. The judge is appointed three times: two are in hell and one is in paradise.
32. Amr ibn al-As: If a ruler rules, strives, and then is correct, he has two rewards.
33. Umm Salamah: You bring your disputes to me, and perhaps one of you is more persuasive in his argument than the other.
The people who appointed a woman as their leader will never succeed.
35. Abu Hurairah narrated that the Messenger of Allah (peace be upon him) cursed the one who bribes and the one who accepts the bribe.
