Jurisprudential rules

Course Description: This course includes an introduction to the science of jurisprudential rules (the reality of jurisprudential rules, their types, and their importance), the origin of the rules and inferring from them and methodologies of their compilation, and a study of the five major jurisprudential rules.

Credit hours: 3

Objectives of the course :

By the end of this course, students will be able to:
a. It is identified by the science of jurisprudential rules, its importance, its fruits, and its methodologies of compilation.
b. Analyzes some jurisprudential rules and their examples, and their contemporary applications.
c. Acquires skills in dealing with jurisprudential rules and benefiting from them.

Knowledge and understanding:
1- It defines the truth of jurisprudential rules.
2. It mentions the types of jurisprudential rules and their importance.
3- It describes the jurisprudential rules branching from the five major comprehensive principles.
4- Summarizes the origin of rules and reasoning with them, and methodological approaches to compilation.
Skills:
1- Analyzes religious texts and distinguishes between them and jurisprudential rules.
Draws jurisprudential rulings for emergent issues based on jurisprudential rules.
Balances jurisprudential rules and jurisprudential controls.
4- Justification and outcome of disagreement in scientific matters.
Values, autonomy and responsibility:
Explains with evidence the rule that the burden of proof lies with the plaintiff and the oath lies with the defendant.
2- In groups, discuss the distinction between the principle of consenting to a thing and consenting to what arises from it, and the principle of the one who is able should not be burdened with the impossible.

The origins of Islamic jurisprudence, reasoning with it, and methods of compilation.
A study of the five major figh principles, 1- The principle of (Matters are judged by their intentions).
2- Principle (Hardship brings ease).
3- Principle (Certainty is not removed by doubt).
4- Maxim (No harm and no reciprocating harm).
Feedback and open discussions on previously covered course vocabulary.
5- Rule (habit is strong).

Study of at least ten general jurisprudential rules related to the specialization: 1- Rule: (Giving effect to speech is prior to neglecting it).
2- Principle: (Mentioning a part implies mentioning the whole), 3- Principle: (The subordinate is subordinate)
4- Rule: (The produce is a guarantee of the debt)
Principle 5: (Ruling over subjects is contingent upon their welfare).
6-Rule: (The proof is on the plaintiff, and the oath is on the one who denies).
7- Principle: (Being content with a thing implies being content with what results from it). 8- Principle: (What is possible is not waived by what is impossible).
9- Rule: (The abrogation of juristic rulings due to the change of times is undeniable). 10- Rule: (Legal permissibility negates liability).
