The purpose of this course is to develop the student's abilities in the field of criminal procedure rules, their understanding of this system, an introduction to the rights of the accused and the procedures of criminal prosecution from its inception to its conclusion with a final, enforceable judgment, in accordance with the principles of Islamic jurisprudence and the regulations issued in this regard in the Kingdom of Saudi Arabia, and comparative systems. This will be within the time frame specified for studying the course.

To know the rights and obligations arising within the scope of criminal procedure.

3. To describe the procedures for invalidating criminal proceedings.

1- To analyze the elements of the criminal procedure system as the subject of study and compare them.
2. To deduce the procedural penalty resulting from a violation of the procedural rule.
3. To write reports and defense memorandums.

To adhere to Islamic values when exercising the role of prosecution against the accused in defense of society, or the role of defense for the accused.

Course Topics:
General introduction to the concept of jurisdiction over grievances, market supervision, and police jurisdiction, and an introduction to the penal procedure system, its nature, characteristics, purposes, sources, and its relationship to other penal sciences and the system of Sharia litigation.
Public criminal prosecution, including its definition, characteristics, parties, scope of prosecution and investigation authority in initiating it, other bodies authorized to initiate it, impediments to its initiation, and reasons for its termination.
The private claim ”the derivative civil claim" includes its definition and elements, as well as the rules and restrictions for pursuing it before the criminal courts.
Pre-trial phase (investigation and inquiry, including defining investigation and inquiry, its nature and procedures, duties of criminal investigation officers and their exceptional jurisdictions - disposal of the inquiry record + mid-term exam.
The pre-trial phase (preliminary investigation) and it includes the definition of the preliminary investigation, its guarantees, its procedures, its disposition, and appeals against preliminary investigation orders.
The trial stage, which includes: its definition, types of criminal courts and their composition, their jurisdictions, general rules of trial, trial procedures, criminal evidence and its proofs, criminal judgment, appealing criminal judgments and their methods.
