Hududud, Qisas and Diyah

Course Description: The course covers the provisions related to Hudud crimes, Qisas crimes, and Diyyat (blood money). It defines the specific elements of each crime and its prescribed penalty. It also distinguishes between Hudud and Qisas crimes in Islamic Sharia, and organized Ta'zir crimes in Saudi criminal law.
Credit hours: 3
Prerequisites: LAW 221
Objectives of the course :

The aim of studying this course is to introduce the student to the provisions specific to Hadd crimes, Qisas crimes, and Diyya crimes, as well as Arsh, in terms of defining the elements of each crime and its prescribed punishment, in accordance with Islamic Sharia, and what is stipulated in the regulations issued in this regard in the Kingdom of Saudi Arabia, and the unified penal law for the Gulf Cooperation Council countries. A comparative approach will be used with regard to practices in other legal systems, within the time limit set for studying this course.

Knowledge and understanding:
1- To understand the systemic and legal concepts and terminology of border crimes, retribution, and blood money.
2- To describe the nature, elements, conditions, proof, punishment, and nullifiers of each crime subject tohudud, qisas, and diyya.
Skills:
1. To independently analyze the legal texts and Sharia rules for each crime by stating its general and specific elements.
2. To apply the regulatory and Sharia rules for hudud, qisas, and diyya crimes to disputes.
3. To compare hudud and qisas crimes in Islamic law with organized ta'zir crimes in penal law.
Values, autonomy and responsibility:
1- To adhere to Islamic values in individual and collective work.
