Upon completion of the course, the student will be able to:
1- Statement of the Hadd and its divisions.
2- Explain the difference between Hadd, Qisas, and Ta'zir.
3- Statement of the Objectives and Philosophy of Islamic Law Regarding the Estimation of Punishments: The Book of Hudud, Discretionary Punishments and Their Penalties in Islamic Jurisprudence.
4- Statement of the rulings for the punishment of adultery, theft, drinking intoxicants, slander, apostasy, and highway robbery.
The judge's authority in sentencing and applying punishment.
6- Aggravating and mitigating circumstances for the penalty.
7- Multiplicity and overlap of penalties, individualization of punishment, precautionary measures.
– Demonstrating etiquette and skills in dealing with those who disagree on controversial issues.
– Utilizing modern technology to access information on course matters.
Knowledge and understanding:
1- To define the terms and concepts ofhudud, qisas, and ta'zir.
2. To mention the jurisprudential rulings on Hadd, Qisas, and Ta'zir with their evidence. .
3- Description of the Scientific Research Methodology for Studying Jurisprudential Issues.
4. To explain the evidence for Hadd and Ta'zir punishments from the Quran and Sunnah according to the scientific methodology of exegetes and hadith scholars.
Skills:
Use technical, computational, and numerical skills in jurisprudential matters concerning penalties, retribution, and discretionary punishments.
2. To deduce the Sharia rulings for Hadd, Qisas, and Ta'zir from their detailed evidence.
3. To apply the jurisprudential rulings for Hadd punishments, Qisas (retaliation), and Ta'zir (discretionary punishments) to specific cases.
