The Jurisprudence of Hudood and Reinforcements

Course Description: This course includes a statement of Hadd punishments and their divisions, the difference between Hadd punishments, Qisas (retaliation), and Ta'zir (discretionary punishment), and an explanation of the purposes and philosophy of Sharia in determining punishments. It also covers Hadd crimes, Ta'zir crimes, and their punishments in Islamic jurisprudence. Furthermore, it explains the rulings for the Hadd punishments of Zina (unlawful intercourse), theft, drinking (alcohol), Qadhf (false accusation of Zina), apostasy, and Hirabah (highway robbery).

Objectives of the course :

Upon completion of the course, the student will be able to:
1- Statement of the Hadd and its divisions.
2- Explain the difference between Hadd, Qisas, and Ta'zir.
3- Statement of the Objectives and Philosophy of Islamic Law Regarding the Estimation of Punishments: The Book of Hudud, Discretionary Punishments and Their Penalties in Islamic Jurisprudence.
4- Statement of the rulings for the punishment of adultery, theft, drinking intoxicants, slander, apostasy, and highway robbery.
The judge's authority in sentencing and applying punishment.
6- Aggravating and mitigating circumstances for the penalty.
7- Multiplicity and overlap of penalties, individualization of punishment, precautionary measures.
– Demonstrating etiquette and skills in dealing with those who disagree on controversial issues.
– Utilizing modern technology to access information on course matters.
